Um, I'm not arguing that. But this Pharm88 guy can claim personal use, bring it over the border, and ship it from within the US. Is it legal for him to ship it, that's a different issue. But does it have to be smuggled up someone's [censored] to get here - no, it definitely does not.

Pharm88 is based in the Phillippines, so smuggling isn't really an issue.
And the bottom line on importing meds: If it is not approved by the FDA, YOU CANNOT IMPORT IT!!!
--->Any med that is manufactured overseas (even things like Indian Roche meds) is NOT APPROVED by the FDA. They can only approve meds that come from manufacturers that they can inspect and certify. The FDA does not have the jurisdiction or the manpower to monitor all the manufacturers worldwide.
I don't know why but it seems every thread contains some kind of debate as to the legality of what we are doing. It's all really a moot point anyway because
1) Customs' job is to control what comes into our country. My understanding is the current protocol is if they discover meds, that becomes the jurisdiction of the FDA. Which means it's ultimately up to the FDA to bust someone illegally importing meds. The problem is (for the FDA, not us), the FDA has no way to enforce the importation laws or to impose any kind of penalty on those caught illegally importing meds. (I could be a little off regarding the details but I'm pretty sure the gist is correct. I watched Congress grill some poor FDA lady on C-Span for hours last year)
2) WHO CARES?!!?!? All that's going to happen is you get a letter from Customs and they seize your stuff. I've placed 40-50 orders over the past 2 years or so, and had one seizure (Health Care Pharma in Thailand). True, you might be out a little money, but in the long run ordering from OP's is way cheaper and more private than using traditional methods.
I know a guy who has had 9 seizures, and he is still in the free world.
Bottom line: don't worry about if it is legal or not, because nobody really cares about your medicine. Unless you are physically crossing a border; then I'd worry.
